1. Welcome and acceptance

These Terms of Use govern your use of cutlerbeauty.com (the "Site") and everything you buy or do through it. The Site is run by [Legal business name] ("Cutler Beauty," "we," "us"). By using the Site, you agree to these Terms and to our [Privacy Policy]. If you don't agree, please don't use the Site.

We may update these Terms from time to time. When we do, we'll post the new version here with a new date. If you keep using the Site after that, you're accepting the changes.

2. Who can use the Site

You must be at least 13 to use the Site. If you're under 18, you may place an order only with a parent or guardian's permission and involvement.

3. Your account

You can create a customer account to check out faster, track orders and use our loyalty program. Please give us accurate information and keep it current. You're responsible for keeping your password private and for everything that happens under your account. If you think someone has used your account without permission, email us right away at hello@cutlerbeauty.com.

4. Orders, prices and preorders

Prices are in US dollars and may change. Taxes and shipping are added at checkout where they apply. When you place an order, you're offering to buy, and we've accepted it when we send a shipping confirmation. We may cancel or limit any order, for example if there's a pricing error, a stock problem, suspected fraud, or signs that products are being bought to resell. If we cancel, we'll refund you in full.

Volume Mist is made in small batches. Some orders ship right away and others are preorders. Preorder dates, charges and cancellations are covered in our [Preorder and Cancellation Policy]. Shipping is covered in our [Shipping Policy] and returns in our [Returns Policy]. Those policies are part of these Terms.

5. Shipping outside the United States

We ship to many countries outside the US, and international shipping rates apply at checkout. If you order from outside the US, you're responsible for any import duties, taxes, customs fees and brokerage charges your country charges. Customs can delay a package, and we can't control that. You're also responsible for making sure the products can legally be brought into your country.

6. Product information

We try to show our products accurately, but colors on your screen, packaging and descriptions may differ slightly from what you receive, and individual results vary. Always follow the directions on the package. Stop using a product if it irritates you, and talk to a doctor if you have a medical concern. Nothing on the Site is medical advice.

7. Reviews and photo uploads

You can leave a review and upload photos through our review provider, Judge.me. By posting, you promise that the content is yours, that it's honest and based on your own experience, and that it doesn't include anyone else's private information or break any law. You keep ownership of what you post, and you give us a free, worldwide, permanent right to use, show, edit and share it on the Site, in emails, on social media and in marketing. We may remove content that breaks these Terms or that we think is harmful, misleading or off-topic. We never pay for positive reviews, and we don't ask anyone to leave only positive ones.

8. Loyalty program

If you join our loyalty program, its rules are in the [Loyalty Program Terms], which are part of these Terms. Points and rewards have no cash value, can't be sold or transferred, and may expire or change as described there. We may change or end the program. If we find misuse, we may cancel points, rewards or accounts.

9. Sweepstakes and promotions

Sweepstakes, contests and special offers have their own official rules, and those rules control if they conflict with these Terms. Where the rules say no purchase is necessary, buying does not improve your chances. Read the [Official Rules] before you enter.

10. Our content and brand

Everything on the Site belongs to us or our licensors: the Cutler name and logo, photos, video, text, designs and software. You may view and use the Site for your own personal, non-commercial use. You may not copy, sell, republish, modify or use our content or brand without our written permission.

11. How you may use the Site

Please use the Site lawfully and respectfully. You may not:

  try to break, overload, scrape or get unauthorized access to the Site;

  use bots or automated tools to buy products or collect data;

  post anything unlawful, abusive, hateful or that infringes someone's rights;

  suggest that we sponsor or endorse you without our written permission.
  

12. Links and third-party services

The Site may link to other websites and use services run by others, including payment, shipping and review providers. We don't control them and aren't responsible for their content, products or privacy practices. Please read their terms.

13. Disclaimers

The Site and its content are provided "as is" and "as available." To the fullest extent the law allows, we don't make any warranties, express or implied, including about quality for a particular purpose. We don't promise the Site will always be available, secure or error-free. Some places don't allow certain disclaimers, so some of this may not apply to you.

14. Limits on our liability

To the fullest extent the law allows, Cutler Beauty and the people who work for us are not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the Site or products. Our total liability for any claim is limited to the greater of the amount you paid us for the order the claim concerns or $100. Some places don't allow these limits, so they may not apply to you. Nothing in these Terms limits liability that can't be limited by law.

15. Your responsibility

You agree to cover losses, claims and reasonable legal costs that we incur because you broke these Terms, broke the law or violated someone else's rights while using the Site.

16. Suspension and ending access

We may suspend or close an account, cancel an order or block access to the Site if we reasonably believe you've broken these Terms or the law. You may close your account at any time by emailing us.

17. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. If we have a dispute, please email us first at hello@cutlerbeauty.com so we can try to work it out within 30 days. If we can't, any claim must be brought in the state or federal courts located in [County], New York, and you and we each agree to those courts' jurisdiction.

18. The fine print

These Terms, with the policies they link to, are our entire agreement with you about the Site. If a court finds part of them unenforceable, the rest stay in effect. If we don't enforce a right right away, we haven't given it up. You may not transfer your rights under these Terms. We may transfer ours, for example if our business is sold.
